Terms of Service

1. Scope
These terms of service apply to the use of the web application SomaViva (app.meinsomaviva.com), operated by Christoph Stern, Bruckergasse 21, 6060 Hall in Tirol, Austria. By registering and using the service, you accept these terms.
2. Service Description
SomaViva is a web application for personal documentation of health data (sleep, mood, nutrition, body sensations, fluid intake). The app allows sharing selected data with practitioners. SomaViva serves exclusively for personal documentation and is not a medical device.
3. Account and Access
Access is passwordless via Magic Link to your email address. You are responsible for the security of your email account. One account per email address is permitted. The account is personal and non-transferable.
4. Subscriptions and One-Time Purchases
SomaViva offers a free basic plan and paid subscriptions (Plus, Pro) with enhanced features. Additionally, one-time purchases (PDF export, AI credits, photo packs) are available. Current prices can be found on the pricing page. Price changes will be announced at least 30 days in advance.
5. Payment
Payment processing is handled by Stripe. Subscriptions are billed monthly in advance. One-time purchases are charged immediately. Accepted payment methods: credit card (Visa, Mastercard, AMEX), SEPA direct debit, and other methods supported by Stripe.
6. Cancellation and Withdrawal
Subscriptions can be cancelled at any time at the end of the current billing period. Cancellation is done via the customer portal (Settings → Manage subscription). After cancellation, you automatically switch to the free basic plan. For one-time purchases: digital content is exempt from the right of withdrawal (§18 para. 1 no. 11 FAGG) once use has begun.
7. Medical Disclaimer
SomaViva is not a medical device and does not replace medical consultation, diagnosis, or treatment. The documented data serves exclusively for personal overview and communication with practitioners. For health concerns, consult a doctor.
8. Liability
We strive for high availability and data security but do not guarantee uninterrupted availability. Liability is limited to intent and gross negligence. We assume no liability for data loss due to force majeure, technical failures, or third-party attacks, provided reasonable security measures have been taken.
9. Changes to Terms
We reserve the right to change these terms of service. Material changes will be announced at least 30 days before taking effect via email. If you do not accept, you can delete your account at any time.
10. Applicable Law
Austrian law applies. Place of jurisdiction is Innsbruck, Austria. For consumers, the mandatory provisions of consumer protection law at the place of residence apply.
